The Probate Process can vary in complexity, depending on the specific circumstances of each case. That is where we can help. That is why we break the Probate Process down in the following steps.
Step 1: Notify Beneficiaries and Heirs
The first step is to formally notify all beneficiaries and heirs that you are commencing the Probate Process.
Step 2: Contact Financial Institutions
The executor or administrator is in charge of locating and gathering all of the deceased’s assets, including their real estate, their financial accounts and their personal possessions.
Step 3: Draft and File Probate Documents
This entails submitting all the required paperwork to the court and designating an executor or administrator to oversee the estate.
Step 4: Prepare an Accounting

- Having received authority from the court to manage an estate, the executor can gather all assets and then distribute them as required.
- Assets are distributed either according to the will or according to intestacy rules (if there is no will).
- The executor will also file taxes and pay any debts owing by the estate.
