Dealing with a family loss is plenty on its own, but managing their Estate is an entirely different matter. When there is no Will, one must apply for a Grant of Administration which initiates the probate process. Through the process, an administrator is appointed to manage an estate after someone dies. The person who is closest to the deceased typically acts as the administrator and applies for a Grant of Administration.

Does an estate need an Administrator?
When someone passes away and did not name an executor in their Will - or did not prepare a Will - then the family must choose an administrator who will be approved by the court. The roles of an executor or administrator are the same, with the difference that there is an administrator when there is no Will naming them. Grants of Probate give authority to the administrator to handle an estate including identifying heirs, gathering assets, paying debts or taxes and distributing the estate.
Why is a Grant of Administration important in the Probate Process?
A Grant of Probate allows the process of eventually distributing assets to begin pursuant to the deceased's Will. If the deceased did not prepare a Will, the process can not begin without court approval which is granted through the Grant of Administration.
How to apply for Grant of Administration
The closest relative of the deceased will normally apply for a Grant of Administration. Typically, this is the surviving spouse, oldest child or closest living relative.
Applying for a Grant of Administration is an emotionally challenging task. It requires obtaining a copy of the death certificate, notifying relatives, and gathering financial information. After this, you can apply for a Grant of Administration from the court before finally distributing assets.
