Guardianship
Under the BC Family Law Act, parents are automatically considered a child’s guardian whether they live with the child or not. As long as the parent takes care of the child regularly, they are legally considered the child’s guardian.
If someone who is not the parent wishes to become a guardian, they can do so by applying for a Court Order or if stated in a Will.
